論刑事判決之效力
摘 要
刑事判決的效力在維護(hù)司法權(quán)威、法的安定性和秩序的穩(wěn)定性方面，以及在保障基本人權(quán)和實(shí)現(xiàn)訴訟經(jīng)濟(jì)方面發(fā)揮著不可替代的作用。既判力是刑事判決效力的核心，而在我國(guó)刑事判決的既判力卻沒(méi)有得到應(yīng)有的維護(hù)，既判力的適用范圍缺乏明確的規(guī)定，以及受傳統(tǒng)“客觀真實(shí)”、“有錯(cuò)必糾”的訴訟觀念的影響等，既判力的作用未能得到充分的發(fā)揮。此外，作為刑事判決效力另1方面的證據(jù)效力，由于司法解釋規(guī)定過(guò)于籠統(tǒng)，在司法實(shí)踐中也存在較多混亂。從這兩個(gè)方面來(lái)分析問(wèn)題并努力探求解決之道，對(duì)于完善我國(guó)刑事判決效力制度具有重要的意義。

Abstract
The validity of criminal judgment plays a unique role in maintaining judicature authority, law stability and social order, as well as in ensuring basic human rights and the realizing accusatory economy. Res-judicata is the core in the validity of criminal judgment. However, it was not maintained in criminal judgment in our country. Also, there was short of obvious stipulation to express the suitable scope of res-judicata. Meanwhile, Affected by the traditional accusatory idea that "objective is ture” and “the mistake must be investigated", the function of res-judicata can not obtain in full display. In addition, as another evidence potency of the criminal judgment, the judicial interpretation stipulation is too general so that there exists chaotic in the judicial practice. It has great significance to consummate our country criminal activity decision potency system by analyzing the question and seeking road of the solution diligently from these two aspects.
