信賴利益與期待利益的區分

摘要

富勒的信賴利益理論向我們有力證明了合同信賴利益的保護是合同法目的所在。信賴利益的賠償不僅在合同不成立或無效的場合存在，而且在合同有效時也會產生。在合同有效時，盡管我們經常看到的是期待利益的賠償，但其背后真正目的仍然是保護當事人的信賴利益。大陸合同法以“合意論”為理論基礎，以合法有效的合同為規范的中心，以違約責任作為合同責任的主要形式，以預期利益的保護為合同法的主要目的。在這1構造中，信賴利益只起輔助作用，只是在違約責任和侵權責任力所不及的地方發揮作用，只適用于合同的不成立或無效的場合。因此，本文通過分析信賴利益與期待利益的區分和價值，提出我國合同法應借鑒富勒的信賴利益理論完善合同賠償制度，使得我國法律對合同的保護貫穿于始終。

Abstract

The reliance interest theory of Fuller powerful proves that the protection of reliance interest of contract is the aim of contract law. Compensation of reliance interest not only exists when contract is untenable or invalid situation, but also exists when contract is effective .When the contact is effective, we often pay attention to the compensation of expectation interest, but in truth, the purpose still is the protection of parties’ reliance interest .The contract of Civil law takes “Meeting of mind theory” as theoretical basis , takes legitimate valid contract as the norms’ center ,takes breach liability as the main form of contract liability, takes expectation interest protection as the main goal of contract law. In this continental, reliance interest only plays the assistance role, when breach liability and tort liability is not at work, it is only suitable to the contract in untenable or the invalid. Therefore, this article analysis the difference and value of reliance interest and expectation interest, proposed our country contract law should learn from the reliance interest theory of Fuller consummation contract compensation system, for our country law of the protection passing through the contract to throughout.
