論土地承包經營權出租
摘 要
土地承包經營權出租是指土地承包經營權人將土地承包經營權出租給他人（包括單位和個人）經營，他人支付土地租金的行為。現階段，出租作為土地承包經營權流轉的重要方式，在我國普遍存在并且出現了大量的問題。而理論界對土地承包經營權能否出租，出租與轉包是否為同1法律概念分歧不斷，土地承包經營權出租的立法規(guī)定也較為混亂，進而使得土地承包經營權出租實踐中的問題得不到有效解決。根據當前存在的問題，立法機關在以后的立法過程中，1定要強化土地承包經營權的物權性質，厘清土地承包經營權出租法律關系主體，明確出租雙方權利與義務，制訂詳盡的出租操作規(guī)程，以到達農民承包地自愿、規(guī)范、有序、依法出租的目的。

ABSTRACT

iring working instruction. Arrives the farmer to contract the standard voluntarily, to h-
